Following Warwick District Council appointing Speller Metcalfe Malvern Ltd under a Pre-Construction Services Agreement to provide pre-construction services, including design services, for the refurbishment and extension works of Newbold Comyn and St Nicholas Park Leisure Centres, the entire construction work was (in accordance with the provisions of Pre-Construction Services Agreement and the council"s option therein) awarded to this contractor (using an NEC3 ECC Option A contract).

For the avoidance of doubt, the procurement exercise covered both the Pre-Construction Services Agreement as well as this construction contract, and under this procurement exercise, only a tenderer who was awarded the Pre-Construction Services Agreement was eligible for being considered for the construction phase. The award of the construction contract was in accordance with the terms of the Pre-Construction Services Agreement and the outcomes delivered under it, and such award was always at the sole discretion of the council.
Refurbishment of Leisure Centres
Some elements of this contract are likely to be subcontracted.
This Council incorporated a minimum of 10-calendar day standstill period at the point of notification of its intention to award the Pre-Construction Services Agreement. This period allows unsuccessful tenderers to seek further debriefing from the contracting council before that contract was entered into.
