  • The works, supplies or services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons
Explanation:

The Air Commodities Team (ACT), part of the UK Ministry of Defence (MoD), has a contract with Penny and Giles (P&G) for the Spares-Inclusive Repair of Aileron Position Transmitters. The MoD intends to place an amendment to its contract with P&G to enable the MoD to purchase new Aileron Position Transmitter units where it is not possible to repair them. It is considered that this amendment to the contract can be placed using the Negotiated Procedure without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because the Aileron Position Transmitter is a safety critical item which is approved for use on the aircraft and the procurement of an alternative item would need a programme of re-qualification to meet the requirements of the safety case and cause significant technical difficulties in integrating it into the aircraft.
